Full Version: Firm Sues Sony Over Cell

On July 26, Newport Beach, Calif.-based Parallel Processing filed a complaint against Sony that alleges the infringement of patent no. 5,056,000, according to a filing obtained by Next-Gen.

The patent, “Synchronized Parallel Processing with Shared Memory” was issued in October 1991. It describes a high-speed computer that breaks down a program “into smaller concurrent processes running in different parallel processors” and resynchronizes the program for faster processing times.

Parallel Processing, the “exclusive licensee” of the patent, states in the suit, filed in the US District Court’s Eastern District of Texas Tyler Division: “On information and belief, Defendant Sony Corporation of America has infringed and continues to infringe on the ‘000 Patent by making, using, importing, offering for sale and/or selling products among other things, covered by one or more claims of the ‘000 Patent, including, but not limited to, Sony Playstation III [sic].”

Parallel Processing said that Sony’s alleged actions have caused “irreparable harm and monetary damage” to the company.

The plaintiff seeks damages, reimbursement of legal fees, interest and “the impounding and destruction of all Defendant’s products that infringe the ‘000 Patent.”

I can't say that I'm surprised about this, because it seems like there's always someone who's suing over something like this saying that had the rights to the technology years ago.  What I don't understand is why they waited this long to do so.  I mean Sony and others have been talking about the Cell Processor for well over 2 years now.  I wonder if during all that time there was some "B lum" that owns a warehouse down by the docks trying to get Sony to pay out or else...

Oh and by the way just for some background info in 2000, Sony Computer Entertainment, Toshiba Corporation, and IBM formed an alliance ("STI") to design and manufacture the processor.  So I wonder why the lawsuit is just against Sony?

Why do you think the company isn't suing the other two companies who helped create the Cell Processor? I mean IBM has deep pockets as does toshiba.

You might be right, I mean you can just google the term "cell processor" and get the info very easily. I wonder if this will be another Church of England situation where someone is looking for some publicity or quick cash to go away?
I don't think an order to recall and terminate your system is going to be quick cash. They're either looking for big money, or just want their name out there.
Again in seems biased that they are only suing Sony.

IBM is actually using the processors now and has been since September of 2006.

Well I don't really use one claim and one piece of evidence as bias. I say, they don't know much and are suing only Sony because they're the main one's proclaiming the benefits of the cell processors while IBM and Toshiba are quiet of the fact that they even have them. I blame ignorance.
Irreperable harm? If this didn't take off in 1991, it looks like they never had a shot. Seriously, I just realized. Why is Toshiba working with Sony on this, yet they have competing media formats?

I wonder how many IBM servers will have to be taken offline and destroyed too since IBM was using the Cell Processor before the PS3 was even released?
So no more PS3 if they win, witch is very unlickly, phhhht, nobody messes with Sony, expect Nintendo.
Again don't just think of it as Sony. This company is going up against Sony, IBM, and Toshiba.

When I read that, I stopped thinking that this lawsuit would go through for even a second. These guys need better legal advice.
