ya, i would take it in and say it was defective, dont ask for your money back, that could cause problems, just tell them that you want to get a working copy. what exactly was wrong with it? a problem with the disk?

i only left it here because it was meant to be a quick response with an answer and then be done. no need moving the thread all over the forums when it'll be answered and locked shortly, which it now has
if you still have the receipt, simply take it back to the store and get a replacementment. if you don't have the receipt, look in the instruction booklet or on the box (or even on a website) for a customer support number. they'll be able to point you in the right direction if nothing else
hope you get it fixed soon so you can keep on rocking
