"It appears that a sincere apology and the promise of a free arcade game aren't enough to satisfy the unbridled rage of some Xbox Live users suffering from frequent outages -- three Texas residents slapped Microsoft with a class action lawsuit yesterday, claiming that the disruption of the service over the holidays is a breach of the Xbox Live Terms of Use contract. The suit claims the damages suffered from the outages exceed $5 million."

Even though Microsoft are going to be offering a free XBLA game people are still taking legal action. Seems pretty pointless to me. I wonder how long it will be until Microsoft fixes all the XBL problems and gets these people of their backs...

xbl d/l = ~800kbs for me. right now its slowed to around 100 but still id dl a 2 gig demo in like 30 mins. thats pretty damnfast
also microsoft wont loose your forgetting how rigged they are.

I know a lot of you think this is ridiculous, but in reality, I think the suit is justified--people (myself included) PAY for a Gold subscription, which means that, due to an inability to log in, those people paid money for a broken service. That money paid is unable to be used because they can't access the service they shelled out their cash for.
Solution? Rather than a $5 check to all Gold members, maybe Microsoft should give them an extra month? Or however long the court says it was down for? An extra week or two of Gold? That is, of course, if they lose the case.
yeah. our 360 came with a free month of gold, and it's pretty much pointless now. we can't stay on for more than a few minutes, so we can't do anything. are they gonna tell us that we've now lost out completely on our one month free?
my family isn't gonna sue, although anyone that does could probably win at this point...so long as they give us something as compensation i think we'll be ok. but can you imagine how much it would cost microsoft if everyone with a gold account were to sue for the breach of contract and lack of services?

No, they won't--it's a class action suit, which means that M$ will have to provide compensation for EVERYONE affected by the Live problems. For example, my fiance just recently received a $200 check in the mail from her auto-insurance people. At first she thought it was an error, but it turned out they had been slapped with a class action suit for selling credit score information to marketers, so she was compensated in the amount of $200
