Actually, the Intellectual Property Rights to NES games expired, due to an act of congress, that states something like:
If the hardware required to run or that the software was shipped on is rare or unreasonable to be easily found, then the software product's property rights no longer apply. (Makes sense, because, mostly, it would become abandon ware anyway.

No, once the IPRs are expired, they cannot be legally "re-obtained", at least not in the United States.
