LOL,mine brother's found his broke overnight a couple days ago. We still have no idea how it happend. I wont explain it,but lets just say,the screens aren't together anymore...
Nintendo was good to us when my little brother broke his touchscreen out of warranty. Give them a call and see what they can do for you.
Depending on how and where it broke, Nintendo can help you a lot.
I broke my top screen when I smacked it too hard when I didn't catch a bee in Animal Crossing.

i would say that my vote in the warrenty idea when my wii broke i sent it in free of charge they fixed it.

Thats a real shame. And I dont blame you if you forgot it was in your pocket, I do things like that all the time, luckily my Ds is still good condition.
As long as it doesn't look like it was abused they will probably repair/ it for you or give you another one.
